STEPS TO TAKE TO FIND YOUR HOME |

| Get your finances in order |
The next step is to find out how much you can spend on your new home and to get pre-qualified for a mortgage. To do this you need to go to a mortgage broker or your bank. We usually recommend a mortgage broker because they are highly trained professionals who have access to many different lenders with different rates and programs to meet your particular needs. We can help you choose. |
| This is the point at which you have to make a serious commitment to your agent. We will need to meet to discuss paperwork and just exactly how we proceed from here. |
| Together we will come up with exactly the type of home and in what price range and location you should be looking and set you up with a shortlist of suitable homes. |
| We arrange for showings of homes that suite your needs and we work closely together to zero in on that right home, whether it comes from our listing base, the MLS system or from our special matching system. |
We guide you through the offer process. We will draw up the offer with you. We will insert conditions to protect your best interests and then negotiate the very best price and terms that we can. You will make the final decision, but we are there to help, negotiate and advise. |

WHAT HAPPENS AFTER YOUR OFFER IS ACCEPTED |
| The conditions of the offer have to be met |
In most offers, you will have probably put in a condition for a home inspection. The inspector will need approximately 3 hours in your soon to be home he carries out a very thorough inspection of the entire house from roof to basement.
In most cases, the bank or lending institution that is to provide you the financing will have an evaluator go through the house. |
| Once the conditions of the offer have been met |
We send a document to the listing agent that tells them that the conditions have been fulfilled. We get a copy to you for your signature. Your soon to be home is then unconditionally sold and both you and the sellers are bound by its terms. Any changes can only be made by mutual consent. |
This is the point at which you should have your lawyer chosen and ready to go to work for you. We are happy to help with this. We send your lawyer a copy of The Agreement of Purchase and Sale and all relevant documents. |

CLOSING THE DEAL AND MOVING |
| Show your lawyer the agreement |
| A copy of the signed Agreement of Purchase and Sale is sent to your lawyer, who will examine any conditions of sale and note the closing date. |
| All the conditions of your agreement are met |
| During the time between the acceptance of the offer and the closing, all conditions in the Offer to Purchase must be satisfied by the stated dates. |
| If required in the Agreement of Purchase and Sale, a new up-to-date land survey on the property may need to be ordered. |
| Your lawyer searches the title |
| Once all specified conditions have been met, your lawyer will search the title to the property. This ensures that you can purchase it without legal problems. |
| Your lawyer checks into taxes and liens |
| Your lawyer will also be checking into government regulations and other legalities. These include ensuring that the property taxes on the house are up-to-date and that there are no liens on the Property. |
| Mortgage details are finalized |
| Your lawyer or lender will also draw up and finalize your mortgage documents. If you are using financing options, such as a vendor take back mortgage, you’ll need your lawyer to prepare this document too. |
| It’s up to you to make arrangements for final metre readings and payments of utilities at your old home and to begin service at your new home. Now is also the time to make arrangements for moving. |
| It's all over but the signing of the check |
| Your lawyer will prepare a Statement of Adjustment, which will confirm the selling price, the amount that you have to pay the vendor, the balance of the down payment and adjustments. You’ll also need to pay your lawyer for legal fees, which include closing costs and disbursements. A certified cheque for this total should be made payable to your lawyer in trust. |
The day you finally succeed in realizing your goal! It’s the day you can actually call your new home yours. Closing is the day you get the keys and legally take possession. Here’s what will happen: • Your lender will provide the mortgage money to your lawyer • You provide the balance of the purchase price to your lawyer in the form of a certified cheque • Your lawyer pays the vendor, registers the home in your name and provides you with a deed and the keys.

When you purchase a property, it usually includes the land and everything attached to it, such as buildings, trees, shrubs, etc. Most buyers are only interested in purchasing the real estate, not the owner's personal property. What happens when personal property has become a part of the real estate? Is it actually a "fixture" which will now convey to the buyer with the real estate?
There are three tests which usually need to be satisfied. Has the personal property been permanently annexed to the real estate? Is it intended to become part of the real estate? What is the local custom? Fixtures may include shades, heaters, ranges, screens, storm windows, lighting fixtures, etc. To save misunderstanding at the closing--and perhaps the sale--it is important that the seller spell out specifically in the sales agreement what will go to the buyer as part of the property.
